At its January 12th meeting, the FUSD Board of Education:
7.1 Reported on Action taken in Closed Session
The Board unanimously approved settlement Office of Administrative Hearing (OAH) Case No. 2021-AK for full resolution of claims.
8.1 Heard the Superintendent Report
Provided updates in item 16.1.
8.2 Heard the Student Member Report
Students returned from winter break this week, received testing kits over break. Some concerns about Omicron at sites, and some activities are being canceled/delayed.
9. Approved Consent Calendar (items 10.1 - 13.4)
The Board unanimously approved all Consent items.
16.1 Received Updates on the Opening of the 2021-2022 School Year
Superintendent CJ Cammack thanked FUSD staff, students, Trustees and community of parents and guardians for their patience and flexibility in recent weeks, and presented updates on information related to the recent announcement from the California Department of Public Health (CDPH) and Alameda County Public Health (ACPH) in connection to changes in health and safety recommendations.
Key areas of the updated guidance include aspects of quarantine and isolation requirements and related testing recommendations.
Superintendent Cammack also presented information related to AB/SB 130 and the related regulations for instruction.
16.2 Reviewed Resolution No. 025-2122, The Roosevelt Resolution, Transition to a Zero-Waste to Landfill Entity
The Roosevelt Resolution was brought forward on behalf of Thornton Junior High School's Energy & Sustainability Club. The resolution is named for President Theodore Roosevelt, who issued a series of extensive executive orders to protect natural resources, lands, and monuments for generations to come.
The Energy & Sustainability Club is proposing the Roosevelt Resolution to preserve our ecosystems by educating the future on the dangers of plastic. The resolution lays out a framework for the district’s transition into a zero-waste to landfill entity.
The Board reviewed the resolution, and asked that staff bring the resolution forward at a subsequent Board meeting for approval.
16.3 Approved on Third Reading Board Policy 5121, Grades/Evaluation of Student Achievement, Reviewed Administrative Regulation 5121, and Retired Board Policy 5124, Reporting to Parents
Board Policies are periodically reviewed and updated to reflect changes to current language, laws, and practices. Board Policy 5124, Reporting to Parents, was last revised in August 1985. In order to update this Board Policy, California School Board Association (CSBA) recommends adoption of 5121, Grades/Evaluation of Student Achievement. The third reading of the new policy (BP 5121 Grade Evaluation Of Student Achievement) incorporates relevant language from current Board Policy 5124 as well as CSBA language recommendations.
The updates proposed in this item will bring FUSD up-to-date with Education Code. The proposed Administrative Regulation (AR 5121 Grade Evaluation Of Student Achievement) reflects updates to the FUSD elementary report card grades that began use in the 2019-20 school year. Additionally, updates to the AR found in the secondary section reflect current practices. At the September 8, 2021 Board meeting, the Trustees approved the first reading of BP 2121. At the September 22, 2021 Board meeting, the Trustees did not approve the second reading due to clarification needed with wording in the AR.
The Board unanimously approved the third reading of Board Policy 5121 Grade/ Evaluation of Student Achievement, reviewed Administrative Regulation 5121, and retired Board Policy 5124.
16.4 Authorized Staff to Transfer Interest Earned in Fund 21 to Contingency in the Amount of $14,249,963
On December 8, 2021, the Board of Trustees gave direction to the administration to bring back an action item indicating the amount of funds that would be moved to the contingency account within Measure E funds tracked under Fund 21.
Previously staff deposited the interest into the contingency account without formal Board approval. The action tonight will only authorize a transfer in the amount of $14,249,963. Any future interest earned will be tracked in an interest sub-account within Fund 21 and will not be automatically transferred to the contingency account unless the Board takes action to do so.
The Board unanimously authorized the transfer.
16.5 Authorized Staff to Transfer $407,761 From Prop 51 Reimbursements to Measure E, Fund 25 and Fund 40 Split Equally Amongst the Two Funds
On December 8, the Board of Trustees directed staff to bring back an action item in which Fund 25 and Fund 40 will receive a credit back for expenditures from Rix Early Learning Center from the reimbursements received from the State Prop 51.
On December 8 the Board of Trustees voted to charge Fund 40 and 25 for expenditures from Rix Early Learning Center in the amount of $407,761. This action returns the funds back into Fund 25 and Fund 40. The expenditures were $104,502 for Millennium Consultants and $303, 259 for CPM Environmental.
The Board unanimously authorized the transfer of $407,761 from Prop 51 reimbursements to Measure E, Fund 25 and Fund 40 split equally amongst the two funds.
16.6 Approved the Opening of Lila Bringhurst Elementary School in 2022-2023
On May 8, 2019, District staff presented information to the Board on enrollment projections and timing for opening of Lila Bringhurst Elementary School to sufficiently fill a single grade level from K-5. After discussion, the Board took action, on unanimous vote, to open the Bringhurst School to the public the following school year once the student enrollment numbers reach 160 during the year.
Since December 2020, several technology and mechanical equipment installations were performed to prepare the facilities for the public.
For the 2021-2022 school year, the enrollment numbers were below the Board’s threshold; thus, the District started using the Bringhurst School facilities to temporarily house students from the Hopkins Junior High School which is undergoing construction repairs and renovation and was not ready for safe occupancy for the new school year. Based on current construction timelines at Hopkins, the Hopkins students should be back at the Hopkins campus for the 2022-2023 school year.
As of the date, District staff has identified approximately 233 students living within the Bringhurst School boundary and currently attending other elementary schools District-wide. Under the relevant terms of the Mitigation Agreement, and pursuant to the Board’s action of May 8, 2019, the Bringhurst School must open to its students.
Trustees discussed the possibilities opening this campus presents, from offering that growing neighborhood a school, to a home for existing and new District programs.
The Board unanimously approved opening the Bringhurst School for the 2022-2023 school year.
16.7 Authorized Ratification of the Agreement with Rodan Builders for District and Developers Contingency Expenditure Directives for the Theater Improvements Project at Washington High School
Rodan Builders was awarded the construction contract for Washington High School.
Staff requested Board approval to ratify the agreement with Rodan Builders for district and developers contingency expenditure directives for the theater improvement project at Washington High School in the amount of $419,669.19.
The Board unanimously approved ratification of the agreement with Rodan Builders.
