Board Highlights - February 12, 2020

At its February 12th meeting, The FUSD Board of Education:



Approved Tentative Agreement between Fremont Unified School District (FUSD) and California School Employees Association (CSEA) - On January 23, 2020, CSEA and the District agreed to the following under Article 9.18.1.  This concludes salary negotiations for the District and CSEA for 2019-20.  



Received Presentation of Proposed Budget Balancing Solutions - The District needs to implement $26 million in ongoing budget reductions starting in 2020-21 in order to maintain fiscal solvency, including Board designated reserves. The additional increase from $24 million to $26 million is based on the impact from the District's current salary offer to FUDTA providing for a .56% increase in FY 2020-21 and 1% in FY 2021-22.  The Alameda County Office of Education (ACOE) requires that the District send a detailed list of Board-approved budget balancing solutions no later than March 16, 2020.  Staff is proposing the following categories of budget solutions: 

  1. Category 1 - Increase Revenues
  2. Category 2 - Decreased Spending (Personnel)
  3. Category 3 - Decreased Spending (Programs and Services)
  4. Category 4 - Negotiated Options and other 

Details of each category and estimated budget impacts are outlined in the attached presentation and appendix. Final approval of expenditure reductions will be sought at the February 26, 2020 Board Meeting. 



Received Presentation and Held Public Hearing on the Notice of Availability for the Draft Environmental Impact Report (EIR) for the New Construction and Modernization Project at Thornton Middle School (Middle School Conversion) - This draft EIR was prepared by PlaceWorks, Inc. The draft EIR was formally filed with the State Office of Planning and Research on January 17, 2020. The draft EIR and supporting documents are available for review at the Fremont Unified School District Education Center, at Thornton, and on the District’s website.



Approved Amended Bylaws for SURF Members to Serve on the Wellness Committee



Authorized Staff to Amend the Agreement with Ninyo & Moore for the New Construction and Modernization Project at Thornton Middle School (Middle School Conversion) - Ninyo & Moore’s initial borings and assessment revealed existing soil conditions that required additional boring and further study. The additional soil testing has been completed and Ninyo & Moore has submitted a proposal for the planned amendment, for the construction phase geotechnical engineering services for the design of ground improvements. The findings warranted additional work to be completed at the site to mitigate soil conditions that may impact construction. Additional review is being completed on a solution and will be presented upon completion of the analysis. The findings are not available for review at this time. Staff requested authorization to amend the agreement with Ninyo & Moore for the project at Thornton in the amount of $172,260. Amended total project budget will be $280,170. The cost of this work is within the budget for the project. Board approves by 3-1 vote (Trustee Crosbie votes Nay, Trustee Jones absent).



Authorized Staff to Amend the Agreement with SVA Architects for the New Construction and Modernization Project at Horner Middle School (Middle School Conversion) - The project currently has been approved in back-check with the Division of State Architects Office (DSA) and is in active construction. The DSA plan check process was complicated beyond what was reasonable for a project of this size and scope of work. The design team did not anticipate having such an extensive review process and excessive amounts of comments were received. SVA sub consultants and structural engineer, KPFF Consulting Engineers (KPFF), completed all required changes from DSA on the design documents and reviewed them for completeness. SVA has requested additional services on behalf of their sub consultant, KPFF, for additional time required to respond to an unusually large number of questions and clarifications required for the back check process. Additional time was also required of the structural engineer to complete redesign of elements that eventually led to optimum design changes that resulted in a construction cost savings to the District. This work has been completed and is now under construction. Staff requests authorization to amend the agreement with SVA for the project at Horner in the amount of $172,000. The amended contract amount will be $3,749,108.



Approved Attendance Area Assignments for Planned Housing Developments - The attached chart shows the staff recommendations for attendance area assignments for each residential housing development at different stage of the planning and construction process. The developments listed and project information shown are as reflected on the most recent version of the City of Fremont Development Activity Web Table posted on the City of Fremont website.



Approved the First Reading of Revised Board Policy 4252, Drug and Alcohol Testing for Safety Sensitive and Transportation Employees and Review Administrative Regulation - The Board Policy and Administrative Regulation have been revised to reflect current laws and practices, as well as information on the Clearinghouse and California School Board Association recommendations. The Board is asked to review and approve revisions to the First Reading of Board Policy 4252, Drug and Alcohol Testing for Safety Sensitive and Transportation Employees to reflect current laws and practices.
