Board Meeting Highlights - August 12, 2020

At its August 12th meeting, The FUSD Board of Education:


Reviewed the Second Reading of Revised Administrative Regulation 5114, Student Discipline – Since the last update in 2008, there have been many changes to California Education Code that should be reflected in AR 5114 to protect the rights of students. On October 30, 2019, the Board of Education approved the First Reading of revised Administrative Regulation 5114, Student Discipline, and reviewed Board Policy. Changes to the Administrative Regulation have been made according to Fremont Unified School District current procedures.  No changes have been made to Board Policy 5114 and it is attached for reference only.


Approved the First Reading of New Board Policy 0415, Equity – The Governing Board desires to make decisions with a deliberate awareness of impediments to learning faced by students of color and/or diverse cultural, linguistic, or socio-economic backgrounds.  To ensure that equity is the intentional result of district decision, the Board shall consider whether its decisions address the needs of students from racial, ethnic, and indigent communities and remedy the inequities that such communities experienced in the context of history of exclusion, discrimination, and segregation. The District’s Equity Committee had the opportunity to review the draft policy and provide comments.  


Approved Memorandum of Understanding (MOU) between FUSD & FUDTA for Distance Learning – FUSD and the Fremont Unified District Teachers Association (FUDTA) worked collaboratively to outline the guidelines regarding working conditions for unit members during Distance Learning as related to the COVID-19 pandemic. The MOU is based on the current, most up-to-date Federal/State/County/Local requirements and guidelines and will become effective August 4, 2020.  The addendum MOU will become effective August 6, 2020. The MOU and the addendum shall expire in full without precedent when the District is removed from the State "watch list" and allowed to move to a hybrid model or until which time the Board of Education determines that students will move to an alternate learning model, which would be subject to bargaining if not covered by the CBA or this MOU. If parties do not change to a hybrid model or traditional schedule by the end of the 2020/2021 school year, this MOU will expire on June 10, 2021. All components of the current Collective Bargaining Agreement (CBA) not addressed by the terms of this agreement shall remain in full effect.


Received Update on the Opening of the 2020-2021 School Year – At the July 10, 2020, meeting, the Board gave direction to begin the academic school year via distance learning.  On July 17, 2020, Governor Newsom announced that counties that are on a State Monitoring List due to elevated disease conditions, including Alameda County, must not open for in-person instruction until their county has come off the Monitoring List for 14 consecutive days. He further announced that reopening guidance should be implemented only with health officer approval following review of local epidemiological data and local preparedness, including contact tracing and testing capacity. Staff provided an update on the District’s preparations for the 2020-21 school year.


Approved Memorandum of Understanding (MOU) between Fremont Unified School District (FUSD) and Fremont Education Foundation (FEF) – The Fremont Education Foundation (FEF) has long been a partner with FUSD and supports After School Band, Innovative Education Grants, Guy Emanuele Sports Fund and other funding needs as needed. The Covid-19 pandemic and the ever-increasing count of cases in California and Alameda County has resulted in a mandate by Governor Newsom to begin the school year in a distance learning model in Fremont. Technology (laptops, chromebooks, and hotspots) are required to ensure all students have access to a rigorous curriculum and their teachers. In order to ensure educators can contact their students and deliver instruction, all educators need reliable and updated technology. The FEF Board of Directors has approved to raise funds for quality distance learning during the 2020-2021 school year. FEF has identified $250,000 as a fundraising goal to support student and teacher technology needs. FEF will be matching up to $25,000 of donations from families, community members, and businesses. Establishing a joint MOU will ensure that all parties are able to collaborate to promote and work together to reach the fundraising goal.


Adopted Resolution No. 006-2021 Making Findings for Technology Procurement and Contracts Awarded Pursuant To Public Contract Code Section 20118.2 – Pursuant to the Board’s authorization, staff subsequently reviewed and negotiated two agreements from Infinite Campus, Inc. for the Student Information System and related services: 1) INFINITE CAMPUS END USER LICENSE AGREEMENT; and 2) INFINITE CAMPUS IMPLEMENTATION SERVICES AGREEMENT. After consultation with legal counsel, staff recommends the Board approve the agreements with further modifications set forth in the Addenda. Each amendment adjusts essential terms of the Infinite Campus agreements to ensure they are consistent with the RFP requirement that California law apply, and to ensure the contracts are compliant with California law, including contract term requirements and California-specific data privacy requirements. Consistent with the Board's July 8, 2020 authorization to enter into an agreement with Infinite Campus, Inc., the attached resolution is presented for the Board to make statutory findings in connection with approval of the Infinite Campus agreements.


Held Committee Membership Discussion on Family/Couples Sitting on Committees – FUSD offers a myriad of committees in which parents, educators and community members can participate. Those interested in joining committees must complete an application, which is then reviewed and decided upon by the FUSD Board of Education Trustees. Current criteria for applying to each committee is available here. Board Direction is to state on application if applicant is related to an FUSD Staff Member and if applicant resides within same household as somebody currently serving or is applying to serve.


Re-Evaluation/Envisioning of SRO Program - Establishment of a Task Force – Currently, a School Resource Officer (SRO) is assigned to each of the six high schools and serves all schools and offices throughout the District. The mission of the SRO unit is to ensure a safe learning environment for students, teachers, and school administrators. At the July 29, 2020, Board Meeting, Trustees moved to reevaluate the SRO program relationship we have with the City of Fremont and direct staff to renegotiate the contract to allow FUSD to not pay while under distance learning. Staff was also instructed to establish an advisory group as due diligence in the reevaluation process. The proposed SRO Task Force would consist of the following members:

  • 3 CSEA Members (members will be picked by bargaining unit)
  • 3 FSMA Members (members will be picked by bargaining unit)
  • 3 FUDTA Members (members will be picked by bargaining unit)
  • 3 SEIU Members (members will be picked by bargaining unit)
  • 3 Student members (members will be picked by SURFBoardE students)
  • 5 Community members (one from each attendance area; members approved by the school board)
  • FUSD Director, Student Support Services, Greg Bailey (Facilitator and answers questions, non-voting)
  • Fremont Police Department Sgt. Mike Rodriguez (Facilitator and answers questions, non-voting)

Applications will be submitted to Staff with a due date of September 3, 2020. Applications will be brought to the September 9, 2020 Board meeting for a vote.  The Task Force will be asked to meet September 24, October 8 and October 29, 2020 with a final recommendation to be made to the Board on November 12, 2020. Board votes 4-1 to amend composition of the Task Force and a flexible number of meeting dates. Composition of Task Force: 8 bargaining unit members (2 from each bargaining unit), 6 students, 6 parents, 5 community members, up to 2 Board Trustees, and a District staff, non-voting facilitator.
