Board Meeting Highlights - May 22, 2019

At its May 22nd meeting, The FUSD Board of Education:


Approved Tentative Agreements between Fremont Unified School District (FUSD) and Service Employees International Union (SEIU) - FUSD and SEIU reached tentative agreements that include: 

  • Article 4: Organizational Rights - Request to authorize dues/other deduction(s), or request to change status shall be directed to the Union rather than the employer. 
  • Article 6: Performance Evaluations - An evaluation schedule will be established each school year within a time period.
  • Article 7: Hours and Overtime - When an employee does not return to work on the sixth day, the double-time rate is not paid on the seventh day. Upon return from summer break, drivers will resume their previous route held from the preceding school year.   Annual bidding shall take place in October.    
  • Article 8: Pay and Allowances 


    • Salary increase of 1% effective July 1, 2018
    • Salary increase of 1.5% effective January 1, 2019
    • One-time salary increase of 1.5% off schedule based on above increases


    • Salary increase of 1% effective July 1, 2019 
    • Salary increase of 1.5% effective January 1, 2020
    • One-time salary increase of 1.5% off schedule based on above increases. 
  • Article 8: Safety Boot Allowance - The District shall fund the cost of safety boots.   
  • Article 12: Leaves - Update bereavement leave language to clarify member and/or member's spouse.
  • Article 27: Temporary Reassignment - Updated to include permanent employees.   
  • Article 28: TAK Fudenna Memorial Stadium Assignments - Revised to include TAK side letter agreement in contract. 
  • Article 29: Completion of Agreement - The agreement shall remain in full force until June 30, 2021. 


Approved Letter of Conferment between Fremont Unified School District (FUSD) and Fremont School Management Association (FSMA) - The Fremont Unified School District (FUSD) and the Fremont School Management Association (FSMA) met and conferred with the Superintendent and Assistant Superintendent to discuss the terms of their “Letter of Conferment” between the two parties.


Authorized Staff to Enter into an Agreement with LearnWell (Formerly known as Education, Inc.) for Instructional Services at Fremont Hospital - FUSD is responsible for the education of both general and special education students placed on temporary psychiatric holds. The individualized instruction a student receives is generally known as Home and Hospital Instruction. If the student is able to receive individualized instruction, the District must arrange such educational services for the student no later than five working days after the determination has been made. The educational services provided must include at least one hour of instruction for every day of instruction offered by the District in the regular education program. This instruction must be provided by a teacher with a valid California teaching credential. The District renewed the contract with LearnWell for $138,800 to be paid in monthly installments to provide these services for a patient starting on day six of their treatment at Fremont Hospital. District will receive the Average Daily Attendance (ADA) for all students receiving instruction at Fremont Hospital that extends beyond a five-day hold. The ADA received will be used to help offset some of the costs incurred by this contract.


Approved Proposed Expenditure Reductions - On May 20, 2019, staff presented its proposed budget reductions, including implementation of the following categories of budget solutions:

  1. Recommendation 1 Ongoing Expenditure Reductions
  2. Recommendation 2 Ongoing Expenditure Reductions
  3. Ongoing Budget Reductions in Operations/Programs

Details of each category and estimated budget impact are outlined in the attached presentation. Following the May 20 Study Session, staff created the attached list of items for consideration.  

Board approves by 4-1 vote (Trustee Sweeney votes Nay) to approve the proposed expenditure reductions, as captured in the minutes for a total of  $12.86 million.


Authorized Staff to Enter Into Agreement with Silicon Valley Paving for Traffic Flow Improvement Project at Patterson Elementary School - In accordance with Public Contract Code, Section 20111, the Purchasing Department secured public sealed bids to furnish services necessary for Patterson Elementary School Traffic Flow Improvement Project. The bids were reviewed with the Director of Maintenance, Operations and Grounds for compliance with technical specifications and responsiveness to the bid documents. Staff recommends Board authorization to enter into an agreement with Silicon Valley Paving for the traffic flow improvement project (front parking lot modification) at Patterson Elementary School in the amount of $233,200.


Authorized Staff to Amend the Agreement with Vanir Construction Management, Inc. for Program Management of the Measure E Bond Program - The Board authorized staff to amend the agreement with Vanir Construction Management, Inc. in the amount of $10,596,048 for program management (PM) services for the Measure E bond program. The current contract for PM services with Vanir expires on June 30, 2019. District staff and Vanir have met to review the anticipated services and staff needed to complete the Measure E bond program. The scope of services will commence July 1, 2019, and complete on December 31, 2022 and is based on the draft Implementation Plan to be presented to the Board at its June 5, 2019 meeting. The total contract amount dating back to 2016 and inclusive of all amendments is now $20,482,478.
